MyCC issues a proposed decision for bid rigging in tenders issued by the Ministry of Defence

On 19 December 2023, the Malaysia Competition Commission ("MyCC") issued a proposed decision against seven entities for their involvement in the bid rigging of four tenders issued by the Ministry of Defence, for the provision of goods and services. The total value of the tenders was approximately RM20.8 million (approx. S$5.944 million).
The seven entities, Agenda Eksklusif Sdn. Bhd., Nekad Waja Resources, Star Apax Enterprise, Prospectrum Sdn. Bhd., Spectron Sdn. Bhd., Teknokrat Makmur Enterprise, and NK Panorama Enterprise, were provisionally found to have colluded in their bid submissions for the respective tenders. The MyCC’s investigation also revealed that the entities had engaged in bid rigging by exchanging information, facilitating tender submissions, and subcontracting as a kickback.
The entities have been given 30 days to submit written responses after receiving the proposed decision.
