Decisions of Malaysian Industrial Court can be appealed to High Court following amendments to Industrial Relations Act

The Industrial Relations (Amendment) Bill 2019 (“Bill”) was passed by Malaysia’s Dewan Rakyat (the Lower House of Parliament) on 9 October 2019 and passed by the Dewan Negara (the Upper House of Parliament) on 19 December 2019.
The law has yet to come into force.
This Bill seeks to amend the Industrial Relations Act 1967 (“IRA”) to provide, among other things, the following:
- Creation of the post of Deputy President of the Industrial Court;
- Empower the Director General of Industrial Relations to refer a complaint to the Industrial Court for hearing;
- Allow an appeal of any decision of the Industrial Court to be made to the High Court; and
- Provide for the application of Part VI of the IRA to any statutory authority as determined by the Minister of Human Resources after consultation with the statutory authority.
