Malaysia Competition Commission accepts undertaking from association of tourist guides for price fixing

On 3 September 2019, the Malaysia Competition Commission (“MyCC”) accepted an official undertaking by the Sabah Tourist Guide Association (“STGA”) in relation to the fixing of the tourist guides’ professional fees.
In response to the MyCC’s concerns, the members of STGA have undertaken:
- to rescind the issued Minimum Tourist Guides’ Professional Fees that was published on STGA’s website to fix the fee rates of tourist guides;
- not to hold any form of discussion regarding tourist guides’ fees that are applicable to STGA members;
- to halt the implementation of the proposed STGA Sabah Professional Guiding Fee Rates; and
- to remind its members to fully comply with the Competition Act 2010 and to provide its full cooperation to MyCC in the event there are any future competition concerns against their members.
