On 27 December 2024, the Workplace Safety and Health Council (“WSH Council”) announced the publication of the Approved Code of Practice (“ACOP”) for Platform Services. The ACOP provides practical guidance for platform operators to ensure the safety and health of delivery and ride-hail platform workers. In line with the commencement of the Platform Workers Act 2024, the ACOP took effect from 1 January 2025. 

The Workplace Safety and Health Act 2006 (“WSH Act”) has been amended by the Platform Workers Act 2024 to clarify platform operators’ responsibility for the safety and health of platform workers when at work, and platform workers’ responsibility to cooperate with platform operators on safety measures. The WSH Council explains that adopting measures under the ACOP can be a mitigating factor in criminal proceedings under the WSH Act as it demonstrates that reasonably practicable safety measures have been taken by the platform operator and platform worker.
