Malaysian Land Public Transport (Amendment) Bill passed, not yet in force
5 November 2018
The Land Public Transport (Amendment) Bill 2018 (“Bill”) was passed by the Upper House of Parliament on 12 September 2018. It had been passed by the Lower House of Parliament on 16 August 2018. It has yet to come into force.
The Bill makes amendments to the Land Public Transport Act 2010 which are consequential to the repeal of the Suruhanjaya Pengangkutan Awam Darat Act 2010 and the dissolution of the Land Public Transport Commission (“Commission”).
The Bill devolves the functions, powers, rights, duties, liabilities and obligations of the Commission to the Director General of Land Public Transport or the Director General of Road Transport, as the case may be.
The Bill also provides that any contract which purports to negate or restrict the liability of any persons in respect of any claims which could be made lawfully made against that person in respect of death or bodily hurt caused to a passenger of a public service vehicle, tourism vehicle or railway will be void.
Finally, it revokes any policies or plans made by the Commission, including the National Land Public Transport Masterplan.
The Bill is available on the website of the Malaysian Parliament http://parlimen.gov.my/, or by clicking here.
